Legal Enforcement of Patent Initiated

The enforcement of this patent has been initiated in Tyler, Texas, a federal jurisdiction known for its rapid adjudication of cases or as understood in the legal community a, “Rocket Docket.”  This lawsuit has the potential of having far reaching effects for MCVE.

This  first lawsuit connected to its patent on mobile data collection systems across wireless networks, smartphones, tablets and other mobile devices.

The targeted companies in the suit, filed last week in the Texas Eastern District Court in Tyler, are Blue Shoe Mobile Solutions LLC, Brazos Technology Corporation, On The Spot Systems Inc. and Formstack LLC.

ReForm XT:  Significance of Patent

As MacroSolve enhances and licenses the ReForm XT platform, the company is positioned to be a major contributor and partner with the leading app stores including Google, Apple, RIM, GetJar and others.  ReForm XT empowers a much broader base of users, from the technically savvy smartphone and tablet enthusiasts to people with no technical backgrounds, to create and manage their own business or even personal apps. Recent Developments

Throughout 2010, the Company marketed both the ReForm XT and associated Insight products across a wide group of industries in order to identify the depth of functionality and unique functionality needed in each market.

Small and Medium Sized Company Product Development for 25 Industries

The Company, with some of its partners, have compiled and manage to a product development roadmap that is comprehensive in both breadth and depth across the top twenty-five industries, with specific attention placed on the needs of small and medium sized companies with limited technical and marketing abilities.

The latest technology and services capabilities generate a growing base of intellectual property, contract and an increasing amount of annuity based revenue. In 2009, MCVE began investing in products which are being distributed through leading mobile application stores.

Blackberry and Android Versions of ReFormXT™ Product Development

Product development continued in 2010 on Blackberry and Android versions of ReFormXT™, which helps to minimize mobile application development effort, and DineInsight™, ClubInsight™ and SchoolInsight™, which uses ReFormXT technology for mobile target marketing, promotions and branding for the restaurant industry, membership organizations and the hospitality industry and educational institutions, respectively.

SaleSentral Software Platform

SaleSentral(TM), a software platform for tablets including the iPad and Android Tablets. Illume Mobile is currently using the SaleSentral platform to develop customized and branded apps for a number of clients across several industries including insurance, food and beverage, healthcare, construction, and office equipment.

SaleSentral is a mobile app platform which provides sales organizations with a mobile sales tool kit that improves efficiencies by as much as 25%. Recently published research indicates the number one use of tablets in a business environment is for sales functions. According to a study by the Yankee Group, sale close rates increase by 26% when reps use mobile devices to present their products, as well as decreasing sales cycles by 23% and reducing redundant activities by 27%.

SaleSentral by Illume Mobile offers sales organizations up-to-the minute videos, brochures, pricing, statistics, contact management information, quote creation tools, contact management integration, promotions and competitive information all on a tablet.

Illume Mobile offers SaleSentral to customers for a one-time licensing fee and an annual support and maintenance contract. Customers can add and revise content through the intuitive web based content management system. SaleSentral and MacroSolve’s suite of app technologies are covered by the company’s U.S. Patent No.7,822,816.

Independent research shows a 25% increase in close rates and sales efficiencies. As businesses recognize the speed and efficiency advantages offered by tablets, SaleSentral is positioned to capture a significant share of the growing sales tool app market.

ReForm XT Platform Products and Services

The Anyware Mobile Solutions division continues to develop, host and maintain the Company’s primary product platform, ReForm XT.

From this platform, the division and its customers develop applications that are both branded and enterprise apps, a unique capability in the marketplace.  Branded apps are being adopted by companies to promote their offerings by placing their app for customers to download for free from the app stores.

This type of application is replacing or supplementing the construction and maintenance of websites.  To address the many industries, the platform has been modified and re-branded ‘Insight’.

Currently, this division licenses, markets and sells DineInsight, ClubInsight and SchoolInsight.

Enterprise apps, which are generally used internally in a company’s operations to streamline communications and related efficiencies, leverage the ReForm XT platform as well.  The division is currently licensing this platform for integration into customer systems for rapid development and deployment to employees and even third parties involved in daily operations.

The Illume Mobile division is satisfying a unique set of market demands by providing advanced mobile application development and maintenance services.  With the exploding growth of tablets, such as the iPad, there are also new ideas on the utilization of this type of mobile device.  Companies with internal drivers to use tablets and even individual entrepreneurs wishing to create the next market leading app, trust the Illume division and its technical, marketing and business development experience to rapidly create a product to be sold on app stores or in other channels.  Where high demand, untapped markets are emerging, this division creates mobile platforms whereby customer demand can be met more efficiently with tools that enable the distribution and customization of apps to be less costly to the partner and end users.

MoBiz e-Marketplace Growth Strategy

The Company began investing in an e-Marketplace Growth Strategy, code named MoBiz, in November 2008 and continued developing the strategy in 2009 and 2010.

MoBiz is centered on the aggregation of all mobile software, hardware, accessories and services in cooperation with our partners, and marketing those using new web-based methods. Due to the general downturn in the national economy, the partner companies involved in developing MoBiz became unable to help finance its completion. Consequently, the Company chose to temporarily cease continued development while it focused on launching the Illume Mobile Division. The technology underlying MoBiz is usable in other projects and the Company does not consider the asset impaired.

Traditionally, customers rely on MCVE to define, design, develop and support the best combinations of technologies in a market that is very technologically dynamic.

Software and web-based application companies are developed by modifying their software product offerings so that they can be used by a mobile end-user who typically has a Smartphone or a similar cellular device. Many of these customers rely on our technology and marketing expertise.

MCVE also serves enterprises that find it difficult to identify a mobile software product which addresses their specific need to streamline operational processes, and do not have the competency in house.

digiTICKET™ Electronic Ticketing Product Sold in February 2010 for $400,000

On February 12, 2010, MacroSolve, Inc. entered into and closed an Asset Sales Agreement with Saltus Technologies, LLC to sell the Company’s assets related to the digiTICKET™ electronic ticketing product.  Pursuant to the agreement, the Company received $400,000 in cash upon closing of the transaction and the Company received an additional $72,263 in cash over a period of eight months for product transfer support services.  The net proceeds were used to further the development and marketing of the Powered by ReForm products.

Operating Strategies

The Anyware Mobile Solutions division has a dedicated staff of development, testing and related engineering staff members which are involved in the daily enhancements of the ReForm XT and Insight platforms.  Some staff members are dedicated to legacy customers with ongoing professional services needs.  The division has dedicated marketing and customer service staff, as well as business development members.

The Illume division has a dedicated staff of lead development and project management staff which is augmented by specialized skill sets inside and outside of the company when needed.  Business development is led by the division head, who also manages commissioned sales agents across the Midwest.

Market Opportunities

The global mobile application (“app”) economy reached $12 billion in 2010 and will grow to $35 billion by 2014 according to recent reports from International Data Corp. (IDC) and MarketsandMarkets (M&M). An independent report commissioned by GetJar, the second largest mobile app store in the world, states the number of mobile app downloads, which totaled 7 billion in 2009 will grow to 50 billion in 2012, a 92% year-over-year growth rate.

U.S. businesses are expected to spend $18.7 billion on mobile apps by 2014, with $9.9 billion of this amount projected to come from small and medium sized business according to a Compass Intelligence report. IDC also reports wireless devices have become pervasive with over 302 million smartphone phones shipped in 2010, an 87.2% increase over 2009 shipments.

When the patent was issued, MacroSolve Chairman Jim McGill said it covers thousands of existing apps that collect data and send it to a central server.

The company said McGill will lead its patent enforcement initiative.

“I look forward to applying my many years of experience in IP monetization to MacroSolve’s patent enforcement efforts,” McGill said in a statement issued Tuesday. “We believe the strength of our patent and the viability of our monetization strategy will lead to the creation of greater value for our shareholders.”

a leading provider of mobile technologies, apps and solutions, today announced its Illume Mobile division has signed two contracts for custom iPad apps. Customers include a leading national pharmaceutical company and a regional office equipment distributor.

A national pediatric pharmaceutical company has purchased Illume Mobile’s SaleSentral(TM) mobile software platform. SaleSentral will be customized, enabling pharmaceutical sales consultants to use their iPads to educate physicians about the company’s products. The customized SaleSentral app will also serve as a new training tool for the pharmaceutical company to train its sales consultants.

Illume Mobile has also been contracted to develop a custom iPad app for a regional office equipment distributor to collect and compare data during pre-sales site surveys. The app will create digital visualization and usage reports resulting in greater efficiencies for both the office equipment distributor and its customers.

Additional software products powered by ReFormXT are in various stages of development. A marketing, promotion and branding product called DineInsight was introduced in the fourth quarter of 2009. Kendall Carpenter joined MacroSolve/Anyware Mobile Solutions in 2006 as Controller. She was promoted to Vice President and Chief Financial Officer in 2008. Carpenter’s previous experience includes Division Controller with Allied Waste Industries (NSYE:AW), a $6.4 billion company, and over ten years experience as top financial officer of an enterprise software company with an international customer base. Carpenter earned a Bachelor of Science degree in Accounting from Oklahoma State University and is both a Certified Public Accountant and a Certified Management Accountant.

Chris Kingham – Vice President, Marketing

Chris Kingham joined MacroSolve/Anyware Mobile Solutions as Director of Marketing in 2004, bringing 15 years of experience in planning, implementing, and marketing high-tech and online properties. Previously, Kingham spent several years at the Williams Companies, serving in both marketing and IT management roles for some of their most critical systems and projects, including Energy News Live, the energy industry’s first live, broadcast-quality online news and information site. Prior to Williams, Kingham spent several years at PennWell Publishing developing the plans and processes to move their flagship publication, Oil & Gas Journal, to the new online medium, broadening readership and generating new revenues. Kingham graduated with a Bachelor of Science in Marketing from Oklahoma State University.

C. McGill – Chairman

Jim McGill serves as Chairman of the Board of MacroSolve, Inc., the parent company of Anyware Mobile Solutions. A registered professional engineer, he graduated Cum Laude with a bachelor’s degree in chemical engineering in 1965 from The University of Tulsa, and received 25 U.S. and foreign patents in the field of pollution control between 1974 and 1985. He has founded several companies, including an environmental technology company specializing in air and water pollution control systems, and a specialty subcontractor for natural gas pipeline construction. He serves on the board of numerous Tulsa area organizations and civic organizations, and also is a trustee of The University of Tulsa. He was named Outstanding Alumnus of TU’s Department of Chemical Engineering in 1987, and admitted into the university’s College of Engineering and Applied Sciences Hall of Fame in 1992.

John A. Clerico

John Clerico is chairman and a registered financial adviser at ChartMark Investments, Inc., an independent investment advisory firm that manages equity funds for individuals and small pension funds. Clerico co-founded ChartMark in 2000, where his current focus is on day-to-day portfolio management and strategic direction of the firm. Prior to founding ChartMark, Clerico served in numerous senior management capacities including Executive Vice President, Chief Financial Officer, and Director of Praxair, Inc., a Fortune 200 company. In addition to his financial responsibilities, Clerico managed Praxair’s business operations in Europe and South America. Prior experience includes CFO of Union Carbide Corporation, Conoco, Inc., and Phillips Petroleum Co. Clerico was named as one of four “Leading Corporate Treasurers” by Corporate Finance magazine in 1995 and “CFO of the Year” by CFO magazine in 1997 and BusinessWeek in 1998.

David L. Humphrey

David Humphrey currently serves as the Chief Operating Officer of Oklahoma Equity Partners, a newly formed $20 million venture capital fund. Oklahoma Equity Partners will focus exclusively on Oklahoma venture opportunities and will utilize a network of venture capital firms as lead investors. Humphrey is responsible for all investment operations of Oklahoma Equity Partners. Prior to joining OEP, Humphrey served from 1997 to 2004 as a principal of Davis, Tuttle Venture Partners, a $45 million venture capital fund. From 1995 to 1997, Humphrey was a senior business development coordinator at Texaco Natural Gas Liquids. During his two-year stay with Texaco, he led ten major acquisition and expansion projects. Prior to joining Texaco in 1996, Humphrey spent thirteen years with Koch Industries, Inc. Humphrey earned his Bachelor of Science in Chemical Engineering from the University of Wisconsin and his Master of Business Administration from Texas A&M University.

Howard Janzen

Howard Janzen is currently president and CEO of One Communications, a leading integrated communications provider located in Boston, Massachusetts. Formerly, Janzen was president of Sprint Business Solutions, where he led the business unit responsible for the $12 billion revenue Sprint worldwide business customer base. Additional responsibilities included integration of Sprint’s wireless, wireline, and local voice and data services. Prior to joining Sprint in May 2003, Janzen served as chairman, president and chief executive officer for Williams Communications, where he led the company in completing its $7 billion next-generation fiber network. Janzen joined Williams in 1979 and served in a number of leadership roles in Williams’ energy and natural gas pipeline business. In January 1995, he was named president of the communications business unit of The Williams Companies, Inc. In April 1997, he became president and chief executive officer of Williams Communications Group, which became an independent company in 2001.

Dr. Dale A. Schoenefeld

Dr. Dale Schoenefeld serves as Vice President for Information Services and Chief Information Officer at the University of Tulsa with oversight and leadership responsibility for academic computing, administrative computing, networking services, computer system administration, and university libraries. He is also Professor of Computer Science and Mathematics. He represents the University of Tulsa at OneNet, Oklahoma’s telecommunications and information network for education and government, and is a member of an Oklahoma statewide committee chaired by the Secretary of Science and Technology. Prior to becoming Vice President and CIO, Schoenefeld served as Vice Provost and as Director of the Computer Resource Center. He received his B.A.E. at Wayne State College and his M.S. and Ph.D. at the University of Iowa. His research expertise is in the area of combinatorial optimization and involves applying optimization techniques to the design and operation of telecommunication networks, often using evolutionary computing.

David R. Lawson

David R. Lawson joins the board following MarcroSolve’s receipt of a landmark mobile technology patent.  Mr. Lawson is a prominent Tulsa-based business person who holds board seats at leading corporate, educational, and non-profit institutions. He has held numerous executive positions at companies in industries ranging from finance to technology.

Currently Chairman of the Board of Trustees at the University of Tulsa, Mr. Lawson also sits on the boards of Heat Transfer Equipment Corp. and Pinnacle Packaging Company. He has served as President and CEO of Capital One Auto Finance, Inc., Summit Acceptance Corporation, and Western National Bancorp. Mr. Lawson has also held board seats at Western Venture Capital, Summit Acceptance Corporation, Zag Inc., Valen Technology, Inc., Dealer Track, Ameriban, Inc., and Texas Capital Bancorporation. He is also on the board of the Alzheimer’s Association.
